The interest group model of regulation

As I discuss the interest group model regulation it is significant to address the notion of regulation to have an understanding of what it entails and how it effects the environment we live in. The term regulation became into fruition due to the absence of our healthcare systems to maintain financial stability and the lack of quality and safety measures therfore resulted in implementation of regulations to enforce protocols.

Regulations are measures that are put in place by governing agencies to regulate and protect the  wellbeing of individual rights. Hence as it relates to healthcare regulations are designed to protect patients rights.  Regulations are very important factors that play a vital role in patient safety and the quality of care that they receive.

The Interest Group Model of Regulation

When discussing interest group model regulation, it is vital to address the notion of regulation to understand what it entails and how it effects the environment we live in. According to Lee (2019), regulation came into fruition due to the inability of our healthcare systems to maintain financial stability and the lack of standard quality and safety measures. Regulations were, therefore, implemented to enforce protocols. Regulations are measures that are put in place by governing agencies to regulate and protect the wellbeing of individual rights. Hence as it relates to healthcare, regulations are designed to protect patients’ rights. Regulations are very important factors that play a vital role in patient safety and the quality of care that they receive.

Legislations are not always implemented to serve the interests of the general public. The interest group model of regulation posits that legislators are like markets in that they both implement regulations that cater to their interests. Any regulatory barriers implemented to discourage competition are harder to breach when compared to competitive advantages. For instance, it is easy for organizations to copy product features but it is impossible to breach regulations because everyone must adhere to them (Lee, 2019).

Regulations help well-established firms to gain market power by limiting competition, introducing strategies for professional control such as licensure, and using them as competitive strategies. In the healthcare industry, examples of regulations that were implemented to limit competition include licensure requirements for telehealth providers which were implemented to limit market entry. It is legal for organizations to lobby for laws that prevent competition but it is illegal for firms to come together and work on preventing their competitors from entering the market. Licensure is a form of regulation that focuses on professional control. In most cases, licensing requirements protect the interest of the regulated professional group rather than the safety and health interests of the general public. Arguably, licensure is more restrictive that other forms of regulation such as certification and in healthcare, licensure is justified by the argument that it ensures that all healthcare professionals are competent in their fields. Regulations are used as to enhance competitive advantage especially when they are imposed on rival organizations. It is natural for organizations to resist new regulations hence when they are implemented, such organizations become less competitive than they were before (Lee, 2019).

There is growing concern among the general public that interest group bias exists and that the public no longer has representation during the drafting and implementation of regulations. Interest groups are expected to serve as mediators for citizens by informing policymakers about the needs of the people (Flothe, 2019). The interest group model of regulation raises concerns regarding the strategies used to regulate lobbyists and the lobbying process and whether regulating interest groups is actually an effective strategy for preventing these groups from implementing regulations that serve their own purposes (Finger, 2018).

I feel that in the healthcare industry where regulations impact the quality of care received, the main focus of these regulations should be to further the interests of consumers rather than that of organizations or other interest groups. The Bible, for instance, was written to guide Christians through their lives hence it focuses on the interests of the people. 2nd Timothy 3:16-17 states “All Scripture is breathed out by God and profitable for teaching, for reproof, for correction, and for training in righteousness, that the man of God may be competent, equipped for every good work” (English Standard Version Bible, 2001). Joshua 1:8 also encourages Christians to follow God’s laws and states, “This Book of the Law shall not depart from your mouth, but you shall meditate on it day and night, so that you may be careful to do according to all that is written in it. For then you will make your way prosperous, and then you will have good success” (English Standard Version Bible, 2001).
